What is Worker’s Compensation

Workers' compensation, also known as workmans' comp, is a state-mandated insurance program that provides compensation to employees who suffer job-related injuries and illnesses.

In general, an employee with a work-related illness or injury can get workers' compensation benefits regardless of who was at fault -- the employee, the employer, a coworker, a customer, or some other third party. In exchange for these guaranteed benefits, employees usually do not have the right to sue the employer in court for damages for those injuries.

No Fault Injuries

The New York State No-Fault Law

The New York State No Fault Law provides for the payment of benefits to victims of motor vehicle accidents. These expenses include: all necessary doctor and hospital bills and other health services expenses; 80% of lost earnings, with a maximum of $2,000.00 a month, for up to three years following the date of accident; up to $25.00 per day for a period of one year from the date of accident for other reasonable and necessary expenses incurred because of a resulting injury, i.e. transportation to and from medical providers, the hiring of a baby sitter, etc.; and a $2,000 death benefit, payable to the estate of a covered person. These are the minimum benefits required in every motor vehicle insurance policy in the State of New York. Your benefits may be greater if there is extended coverage on your policy or on the policy of the liable party. Call us and we will answer any of your questions.

Why see a No Fault Doctor & Physical Therapist

A No Fault Doc can help you if you have been involved in a car accident. You may have been the driver, a passenger, a pedestrian, or even a bicyclist… seeing Our No-Fault Dr. is the next step  AFTER you leave the Emergency Room, where that doctor will typically order X-Rays and prescribe Advil….If you wake up stiff, sore and have unexplained pain or bruising, come to Parkchester Medical.

Parkchester Medical’s No-Fault doctors work in conjunction with our physical therapists. Physical therapists handle the day to day care of the patients. Physical therapists will use heat stimulation to loosen tight muscles, cold pads to prevent or decrease swelling, and possibly some strength and conditioning exercises. No fault doctors will sometimes prescribe physical therapists to work on a patient. If the physical therapist can strengthen the muscles around the joint such as a knee or shoulder, then  sometimes an operation can be prevented. In a post operation situation the physical therapist has a vital role in rehabilitating the patient with a variety of exercises in conjunction with heat and cold therapy. The best case scenario is when a no fault doctor has a physical therapist, and chiropractor under one roof. Parkchester Medical has all three of these services. There are several offices in NY that provide these services but, you have to be careful because many of these offices have will use unsavory characters called runners to steer patients to their offices. These people are directly responsible for higher insurance rates in states such as California and New York. A lot of times these runners will set up fake accidents and send patients to these doctor offices.

No Fault Doctors and Physical Therapists are critical in personal injury lawsuits. If you are involved in a personal injury lawsuit a fully contained no fault doctor’s office is critical is to your case as these offices are used to preparing doctor reports that will stand up in court and  your personal injury attorney will absolutely need these reports for your case. They also will prescribe a battery of test such as range of motion and nerve conductor tests which are critical for your personal injury case. They have to go the extra mile for proof of your injuries as the New York courts are very stringent as to proof of your injuries.

It is also important to pick the proper location for your doctor. This is very critical and not to be overlooked. Most people will probably treat between a few weeks to a few months. Going two to three times a week for therapy  is crucial

Who is a No Fault Doctor?

Simply put a no-fault doctor is a physician who accepts no-fault insurance. Parkchester Medical will treat you and accept No Fault Insurance so you have no out of pocket costs at all. No Fault insurance is covered by either your car insurance (if you were a passenger in a car), or if you were a pedestrian hit by a car. No fault laws are laws that state no matter who is at fault for the accident the insurance carrier of the car you were in will cover your medical expenses. Most cars have a 50/100 policy. That means the car insurance company will cover up to $50,000 per person or up to $100,000 maximum for all of the people in the car.
