The New York State No-Fault Law
The New York State No Fault Law provides for the payment of benefits to victims of motor vehicle accidents. These expenses include: all necessary doctor and hospital bills and other health services expenses; 80% of lost earnings, with a maximum of $2,000.00 a month, for up to three years following the date of accident; up to $25.00 per day for a period of one year from the date of accident for other reasonable and necessary expenses incurred because of a resulting injury, i.e. transportation to and from medical providers, the hiring of a baby sitter, etc.; and a $2,000 death benefit, payable to the estate of a covered person. These are the minimum benefits required in every motor vehicle insurance policy in the State of New York. Parkchester Medical’s No-Fault doctors work in conjunction with our physical therapists. Physical therapists handle the day to day care of the patients. Physical therapists will use heat stimulation to loosen tight muscles, cold pads to prevent or decrease swelling, and possibly some strength and conditioning exercises. No fault doctors will sometimes prescribe physical therapists to work on a patient. If the physical therapist can strengthen the muscles around the joint such as a knee or shoulder, then sometimes an operation can be prevented. In a post operation situation the physical therapist has a vital role in rehabilitating the patient with a variety of exercises in conjunction with heat and cold therapy. The best case scenario is when a no fault doctor has a physical therapist, and chiropractor under one roof. Parkchester Medical has all three of these services. There are several offices in NY that provide these services but, you have to be careful because many of these offices have will use unsavory characters called runners to steer patients to their offices. These people are directly responsible for higher insurance rates in states such as California and New York. A lot of times these runners will set up fake accidents and send patients to these doctor offices.

Simply put a no-fault doctor is a physician who accepts no-fault insurance. Parkchester Medical will treat you and accept No Fault Insurance so you have no out of pocket costs at all. No Fault insurance is covered by either your car insurance (if you were a passenger in a car), or if you were a pedestrian hit by a car. No fault laws are laws that state no matter who is at fault for the accident the insurance carrier of the car you were in will cover your medical expenses. Most cars have a 50/100 policy. That means the car insurance company will cover up to $50,000 per person or up to $100,000 maximum for all of the people in the car.
